If you disagree with \nany of these Terms and Conditions of Use, you must immediately discontinue your \naccess to the iPET Mobile Application and your use of the services offered on the iPET \nMobile Application. Continued use of the iPET Mobile Application will constitute \nacceptance of these Terms and Conditions of Use, as may be amended from time to \ntime \n \nTERMS TO USE \n\u25cfiPET Team is committed to ensuring that the app is as useful and efficient as \npossible. For that reason, we reserve the right to make changes to the app or to \ncharge for its services, at any time and for any reason. We will never charge you \nfor the app or its services without making it very clear to you exactly what you\u2019re \npaying for. \n\u25cfThe iPET app stores and processes personal data that you have provided to us, \nin order to provide iPET Team Service. It\u2019s your responsibility to keep your phone \nand access to the app secure. We therefore recommend that you do not jailbreak \nor root your phone, which is the process of removing software restrictions and \nlimitations imposed by the official operating system of your device. It could make \nyour phone vulnerable to malware\/viruses\/malicious programs, compromise your \nphone\u2019s security features and it could mean that the iPET app won\u2019t work \nproperly or at all. \n\u25cfiPET Team cannot always take responsibility for the way you use the app i.e. You \nneed to make sure that your device stays charged \u2013 if it runs out of battery and \nyou can\u2019t turn it on to avail the Service, iPET Team cannot accept responsibility. \n\u25cfAt some point, we may wish to update the app. The app is available for iOS\u2013 the \nrequirements for the system (and for any additional systems we decide to extend \nthe availability of the app to) may change, and you\u2019ll need to download the \n \n \nupdates if you want to keep using the app. It is your responsibility to keep the \napp version up to date. iPET Team does not promise that it will always update \nthe app so that it is relevant to you and\/or works with the iOS version that you \nhave installed on your device. However, you promise to always accept updates to \nthe application when offered to you, we may also wish to stop providing the app, \nand may terminate use of it at any time without giving notice of termination to \nyou.  \n\u25cfWe strongly recommend that you only download the iPET applications from App \nStore. Doing so will ensure that your apps are legitimate and safe from malicious \nsoftware. \nCOVID-19 SAFETY \n\uf0b7Dog owners health and safety are as important as the health and well-being of your \ndogs, and puppies. \n\uf0b7If the Dog owners or anyone in their family has had a cold, flu or allergy symptoms or \nbeen exposed to, contacted, or overcame COVID- 19 then avoid our app service of \ndog\u2019s socialization. \n\uf0b7Limit contact with the other dog owners. Do not shake hands and disinfect all \ntouchpoints. \n\uf0b7Dog owners should wash hands often with warm water and soap. Use plenty of \nhand sanitizer, if available, as well as keeping the proper social distance of at \nleast 6 feet. \n\uf0b7Do not hand the puppy to the other person. This will put you too close to the \nother person. Set the puppy on the ground or floor and step away. \n\uf0b7Discourage face-to-face contact with the puppies. \nGENERAL TERMS \nLicense Grant; Compliance with Terms of Use. The Application is licensed, not \nsold, and iPET Team reserves all rights not expressly granted in this Agreement. \nSubject to the terms and conditions hereof, iPET Team grants you a personal, \nnonexclusive, non-transferable, non-sublicense able, limited license to download \nand use the Application on a mobile device that you own or control. \n \n \n \nLicense Restrictions. Except as specifically provided herein, You may not: (i) \ndistribute or make the Application available over a network where it could be \nused by multiple devices at the same time; (ii) copy the Application; (iii) modify, \nadapt, translate, reverse engineer, make alterations, decompile, disassemble or \nmake derivative works based on the Application, except as otherwise permitted \nby law; or (iv) use, rent, loan, sub-license, lease, distribute or attempt to grant \nother rights to the Application to third parties. \n \nYour Warranty to iPET Team. You represent and warrant that: (i) You have the \nauthority to bind Yourself to this Agreement; (ii) Your use of the Application will be \nsolely for purposes that are permitted by this Agreement; and (iii) Your use of the \nApplication will comply with all local and national and laws, rules, and regulations \n(\u201cLaws\u201d). \n \nPrivacy. By using the Application, you agree that iPET Team may collect and \nuse certain information about you, your mobile device, your use of the \nApplication and the Application\u2019s performance in accordance with the Privacy \nPolicy, as may be amended from time to time. \n \nIndemnity. You agree to indemnify and hold harmless iPET Team and its \naffiliates, officers, directors, employees, consultants, agents and anyone \nproviding information or software used in the Application from any and all claims \narising from, related to, or incidental to Your use of the Application. \n \nTermination. This Agreement is effective until terminated. iPET Team may \nimmediately terminate this Agreement at any time at its sole discretion with or \nwithout notice to you. Additionally, Your rights under this Agreement will terminate \nautomatically if you fail to comply with any term(s) of this Agreement. Upon \ntermination, all legal rights and licenses granted to You hereunder shall terminate \nimmediately and You shall cease all use of the Application and destroy all copies \nof the Application. All sections that may be reasonably interpreted to or are \nintended to survive this Agreement will survive this Agreement. \n \n \n \nAcknowledgment of Understanding\/Entire Agreement. You acknowledge that \nYou have read this Agreement, understand it and agree to be bound by its terms \nand conditions. You also agree that this Agreement is the complete and exclusive \nstatement of the Agreement between iPET Team and You and supersedes all \nproposals, representations or prior agreements, oral or written, and any other \ncommunications between iPET Team and You relating to the subject matter of \nthis Agreement. \n \nSeverability. You agree that the terms and conditions stated in this Agreement \nare severable. If any paragraph, provision, or clause in this Agreement shall be \nfound or be held to be invalid or unenforceable in any jurisdiction, the remainder \nof this agreement shall be valid and enforceable. \n \nAssignment and Transfer. iPET Team may assign, transfer, sell, rent or lend \nthis Agreement, in whole or in part, at any time without notice to You. You may \nnot assign this Agreement or any part of it or any rights to use the Application, in \nwhole or in part, either temporarily or permanently, to any other party. Any \nattempt to do so is void. \n \nDISCLAIMER AND EXCLUSION OF LIABILITY \n \n\u25cfThe iPET Mobile Application, the Services, the information on the iPET Mobile \nApplication and use of all related facilities are provided on an \"as is, as available\" \nbasis without any warranties whether express or implied. \n \n\u25cfTo the fullest extent permitted by applicable law, we disclaim all representations \nand warranties relating to the iPET Mobile Application and its contents, including \nin relation to any inaccuracies or omissions in the iPET Mobile Application, \nwarranties of merchantability, quality, fitness for a particular purpose, accuracy, \navailability, non-infringement or implied warranties from course of dealing or \nusage of trade. \n \n \n \n\u25cfWe do not warrant that the iPET Mobile Application will always be accessible, \nuninterrupted, timely, secure, error free or free from computer virus or other \ninvasive or damaging code or that the iPET Mobile Application will not be \naffected by any acts of God or other force majeure events, including inability to \nobtain or shortage of necessary materials, equipment facilities, power or \ntelecommunications, lack of telecommunications equipment or facilities and \nfailure of information technology or telecommunications equipment or facilities. \n \n\u25cfWhile we may use reasonable efforts to include accurate and up-to-date \ninformation on the iPET Mobile Application, we make no warranties or \nrepresentations as to its accuracy, timeliness, or completeness. \n \n\u25cfWe shall not be liable for any acts or omissions of any third parties howsoever \ncaused, and for any direct, indirect, incidental, special, consequential or punitive \ndamages, howsoever caused, resulting from or in connection with the iPET \nMobile Application and the services offered in the iPET Mobile Application, your \naccess to, use of or inability to use the iPET Mobile Application or the services \noffered in the iPET Mobile Application, reliance on or downloading from the iPET \nMobile Application and\/or services, or any delays, inaccuracies in the information \nor in its transmission including but not limited to damages for loss of business or \nprofits, use, data or other intangible, even if we have been advised of the \npossibility of such damages. \n \n\u25cfWe shall not be liable in contract, tort (including negligence or breach of statutory \nduty) or otherwise howsoever and whatever the cause thereof, for any indirect, \nconsequential, collateral, special or incidental loss or damage suffered or \nincurred by you in connection with the iPET Mobile Application and these Terms \nand Conditions of Use.
